Welcome to Al-Afnan IT Solutions. These Terms of Service ("Terms") govern your use of our website, products, and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1.Acceptance of Terms
By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Al-Afnan IT Solutions, a company registered and operating under the laws of the United Arab Emirates.
2.Our Services
Al-Afnan IT Solutions provides a range of IT services including but not limited to: • Artificial Intelligence and Machine Learning solutions • Web design and development • IT infrastructure services • Cloud computing solutions • Robotics and IoT integration • Educational technology solutions • Software development • Data management services We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3.User Obligations
When using our services, you agree to: • Provide accurate and complete information • Maintain the confidentiality of your account credentials • Use our services only for lawful purposes • Not interfere with the security or integrity of our systems • Comply with all applicable UAE laws and regulations • Not use our services for any illegal, fraudulent, or harmful activities • Respect intellectual property rights
4.Intellectual Property
All content, trademarks, logos, and intellectual property displayed on our website and in our services are owned by Al-Afnan IT Solutions or our licensors. You may not reproduce, distribute, modify, or create derivative works without our express written permission. For custom development projects, intellectual property ownership will be defined in individual service agreements. Unless otherwise specified, we retain ownership of all proprietary tools, methodologies, and pre-existing materials used in service delivery.
5.Payment Terms
Payment terms for our services are as follows: • All prices are quoted in UAE Dirhams (AED) unless otherwise specified • Payment is due as per the agreed invoice terms • We accept major credit cards, bank transfers, and other approved payment methods • Late payments may incur interest as permitted under UAE law • All fees are exclusive of VAT (5%) which will be added where applicable • Refunds are processed according to our refund policy and UAE Consumer Protection Law
6.Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the course of our business relationship. This obligation survives the termination of any agreement between us. Confidential information includes but is not limited to: business strategies, technical specifications, client data, pricing information, and any information marked as confidential.
7.Limitation of Liability
To the maximum extent permitted by UAE law: • Our total liability shall not exceed the amount paid for the specific service giving rise to the claim • We are not liable for indirect, incidental, or consequential damages • We do not guarantee uninterrupted or error-free service • We are not responsible for third-party services or content Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under UAE law.
8.Termination
Either party may terminate service agreements: • With 30 days written notice for ongoing services • Immediately for material breach of these Terms • Immediately if required by law or regulatory authority Upon termination, you must pay for all services rendered and return any confidential materials. Provisions regarding confidentiality, intellectual property, and limitation of liability survive termination.
9.Governing Law
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. The courts of Dubai, UAE shall have exclusive jurisdiction over any disputes arising from these Terms, unless otherwise agreed in writing. For clients in the Dubai International Financial Centre (DIFC) or Abu Dhabi Global Market (ADGM), the respective laws of those jurisdictions may apply as specified in individual agreements.
10.Dispute Resolution
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through: • Mediation under the rules of the Dubai International Arbitration Centre (DIAC) • If mediation fails, binding arbitration under DIAC rules • The language of arbitration shall be English and Arabic • The seat of arbitration shall be Dubai, UAE This clause does not prevent either party from seeking injunctive relief in appropriate circumstances.
UAE Legal Framework
These Terms comply with UAE Federal Laws including the Electronic Transactions and Commerce Law (Federal Law No. 1 of 2006), Consumer Protection Law (Federal Law No. 15 of 2020), and applicable regulations issued by the Telecommunications and Digital Government Regulatory Authority (TDRA). Our services are provided in accordance with all applicable UAE federal and local regulations.
